The Badung Regency Government has issued clarifications after concerns were raised that a resort hotel was using the beachfront for private access.
In Indonesia, all beaches are open to the public, although some hotels and resorts can rent sections of beach to provide experiences and amenities for their guests on a long-term basis.

The clarifications come as concerns were raised over whether or not The Sakala Resort Bali, located in Tanjung Benoa, was using the beachfront for private access for their guests illegally.
The Head of Regional Asset Management of the Regional Financial and Asset Management Agency (BPKAD) of Badung Regency, Kadek Oka Parmadi, has confirmed that the resort does, in fact, have permission to utilize a section of the public beach for its guests.
After reviewing the licenses, permits, and permissions of The Sakala Resort Bali, Parmadi told reporters, “Every form of beach utilization must be done with the local government. In this case, the land utilization lease proceeds are completely transferred to the regional treasury through a non-cash transfer mechanism.”
“There is no cash payment. Everything is done electronically as a form of local government commitment in maintaining transparency and accountability of regional financial management.”
Parmadi shared, “The contract value based on the results of the third-party appraisal is IDR 1.3 billion and paid cashlessly completely to the Regional Treasury for five years. So, the payment has been made in advance.” He confirmed that the hotel proposed the lease of 2,600 square meters of Tanjung Benoa Beach.
He noted, “This lease agreement does not allow tenants to build permanent buildings. Regarding the coconut tree grower, we said it was for purity, and after we checked, the coconut tree was only planted in some places.”
Parmadi was clear that The Sakala Resort Bali is not permitted to close public access to the section of beach they have leased, but that the hotel is allowed to use the section of beachfront to provide amenities for their guests.
Parmadi shared, “Tenants are not allowed to close public access to the beach. This form of rental is the utilization of views and beach space for economic activities, such as the installation or rental of daybeds, umbrella chairs, or other non-permanent facilities.”

Parmadi that, in addition to ensuring the public can still pass through the section of beach, The Sakala Resort Bali also has an obligation to arrange and maintain the ‘beauty and harmony’ of the environment, so that Tanjung Benoa Beach remains sustainable and comfortable for all tourists to visit.
He noted that the planting of trees in the area is one form of environmental maintenance that has been the responsibility of the hotel as tenants.

Parmadi concluded, “We understand that this issue has caused public attention. Therefore, we at the Badung Regency Government are committed to being open and transparent. Every form of cooperation in the utilization of regional assets is always through the study and evaluation of related technical agencies, so that it does not conflict with the interests of the community.”

The local gov. have rented out the public beach and then they claim it is still "public"? Cannot have it both ways as part of the beach already taken over by the resort.
The whole of Benoa is full of businesses basically building and operating on the beach. There must be huge "rental incomes"?
The same happen in Sanur with resorts and restaurants expropriating beach area for use by their guests.
