Bali Authorities Find No Licensing Violations At Uluwatu Hotel Development

The Regent of Badung has confirmed that all licenses and building permits were in order at the Mirah Development Group construction site in Uluwatu.

The announcement comes after a construction landslide at the site of what will become the Amali Luxury Residences destroyed an ancient limestone cliffside. 

The Regent of Badung, I Nyoman Giri Prasta, shared that based on the investigation, from a licensing perspective, all activities and operations on the sites have been carried out in accordance with applicable statutory provisions.

The land where the licenses have been granted also has an SHM (Ownership Certificate).

However, the investigation found that during the implementation of the building plans, negligence occurred, namely that limestone collapsed onto the shoreline.

Regent Giri Prasta explained to the media crew on the sidelines of opening the futsal tournament at GOR Lila Bhuana, Denpasar on Thursday 25th May that the licensing provisions for the building works on the cliffs were in accordance with applicable laws and regulations.

He said, “The permit from OSS (Online Single Submission) is already underway, and the permit is in place, and the designation is also for tourism accommodation.”

The details of the licensing issued through OSS include Business Identification Number (NIB) Number 2205230078561, KBLI 55120 issued by the Ministry of Investment/BKPM with Medium High-risk classification, Standard Certificate Number: 22052300785610001 issued by the Bali Provincial Government Cq. Head of DPMPTSP Bali Province, as well as an Independent Statement on Maintaining Safety, Security, Health, and Preserving Environmental functions (K3L).

This paperwork was all found to be in order, followed by the Statement of Capability for Environmental Management and Monitoring (SPPL) and an Independent Statement of Willingness to Meet Business Standards.

The Badung Regency Government has confirmed that the Confirmation of Suitability of Space Utilization Activities (KPI) for Business Activities Number 29052310115103054 from the Regent of Badung has also been granted.

The paperwork shows that the Head of Badung Regency DPMPTSP dated the permits for work to commence on the 29th May 2024; this was validated by Badung Regency Public Works and Spatial Planning Service on 26th June 2023, with the designation of tourism space utilization.

Regent Prasta told the press, “I thank the Badung Satpol PP for closing the implementation of this activity because it disturbed the beach due to the arrangement itself.”

He noted that moving forward, due diligence must be carried out, and a negative impact on the surrounding landscape and community must be mitigated.

He added, “And it is no less important to be reminded that stricter supervision is to be carried out. Not only for this business activity but for other businesses, so that similar cases do not happen again.”

Activities at the site of the Amali Luxury Residences by Mirah Development Group remain halted. The Badung Satpol PP has imposed sanctions on Mirah Development Group based on Badung Regent Regulation Number 43 of 2022 concerning SOPs for Badung Regency Satpol PP in the form of Temporary Cessation of Activities.

A statement from Mirah Development Group issued in the days that followed the construction landslide confirms that they will be repairing damage to Pemutih Pecatu Beach so that the shoreline can quickly return to its former glory. Pemutih Pecatu Beach sits between Bingin Beach and Impossibles Beach, both incredibly popular beach vacation spots in Uluwatu. 

Mirah Development Group’s statement reads, “We are committed to learning from this event and reflecting on our practices which have allowed this to occur.”

“We understand the concerns of the local community and of the stakeholders, and we strive to enhance our safety measures to protect our workers and the community and are looking to ways in which we can improve our development planning with better considerations to the surrounding environment.”

“Our development has undergone rigorous licensing and permit processes and adheres strictly to all regulations regarding building ratios and land usage.”
